Glossary

 

Theft Act 1968 "A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanantly depriving the other of it."

 

Police & Criminal Evidence Act 1984 - This Act was introduced to establish a balance between the interests of the community in pursuing criminals, and the rights and liberties of the suspect.

 

The Data Protection Act 1984 "Openess about the use of computerised information and encourages computer users to handle it properly."

 

The Data Protection Act 1998 - Data Protection Principles

Personal Data should be:-

1: Fairly and lawfully processed.

2: Processed for limited and specified purposes.

3: Adequate, relevant and not excessive.

4: Accurate.

5: Not kept longer than necessary.

6: Processed in accordance with the data subjects' rights.

7: Secure.

8: Not transferred to countries outside the EEA without adequate protection.

 

 

The Computer Misuse Act 1990 States that a person is guilty of an offence if "he causes a computer to perform any function with intent to secure access to any programme or data held on any computer; the access he intends is unauthorised; and he knows that at the time he causes the computer to peform the act that this is the case."

 

Criminal Procedure & Investigations Act 1996 A person other than a police officer who is charged with the duty of conducting an investigation with a view to it being ascertained -

whether a person should be charged with an offence, or

whether a person charged with an offence is guilty of it,

shall not in itself render him liable to any criminal or civil proceedings.

 

Protection From Harassment Act 1997 As a result of several high profile "stalking" cases, this was enacted. This made it an offence for any individual to pursue a course of conduct, which amounts to the harassment of another and which he or she knows or ought to know amounts to harassment of the others.
